Welcome to Biolisty. To ensure a safe, reliable, and effective platform for biodegradable products, all Users and Advertisers must adhere to the following rules.

In these guidelines, the platform is referred to as “Biolisty” or “the Site”, the person or business listing a product is the “Advertiser”, and the individuals browsing the directory are “Users”.

1. General Information & Platform Purpose

  • Directory, Not E-commerce: Biolisty is exclusively a directory designed to list biodegradable products and their manufacturers. It is a social and commercial networking platform, not a marketplace or an e-commerce site.
  • No Direct Sales: No buying, selling, or financial transactions take place on Biolisty.
  • Role: Biolisty acts solely as a bridge to connect Users with biodegradable products. The site is not a party to any economic, commercial, or marketing activity between Users and Advertisers.
  • Platform Nature: Biolisty is not a performance-based advertising agency or a product-routing marketing site. Its purpose is to categorize products, provide manufacturer information, and foster social interaction within this sector.
  • Service Interruptions: Biolisty does not guarantee continuous, uninterrupted access to the platform. The site may occasionally experience downtime due to maintenance, updates, or unforeseen technical issues. Biolisty is not liable for any potential loss of visibility, communication, or business opportunities during such periods.

2. Account Registration & Subscription

  • Accuracy of Information: Advertisers are obligated to provide accurate and truthful information about themselves and the businesses they represent.
  • Verification: Biolisty uses its best efforts to verify individuals and businesses using available methods. Biolisty reserves the right to remove accounts and listings that contain fake information, fraudulent ads, or invalid contact details.
  • Account Security: Advertisers and Users are solely responsible for maintaining the confidentiality and security of their account credentials (username and password). Biolisty is not liable for any unauthorized access, loss of data, or fraudulent changes made to listings due to compromised account information.
  • Free and Paid Tiers: Advertisers may be offered a free package allowing a specific number of listings for a limited time. Generally, however, the platform operates on a paid subscription basis.
  • Payment: All membership and subscription fees are collected in advance.
  • Expiration & Deletion: When a free listing period or quota expires, the account is suspended, and the ads are hidden. Paid subscriptions reactivate the listings. Listings not renewed within 15 days of expiration may be permanently deleted, and Biolisty holds no responsibility for this data loss.
  • Policy Acceptance: By registering, Users and Advertisers agree to abide by all Site rules, Privacy Policies, and Data Retention Policies. They also commit to acting in accordance with general morals, commercial ethics, and universal trade principles.

3. Product Listing Rules

  • Eligible Products: Only biodegradable products that fit into the Site’s predefined categories may be listed.
  • Verification & Anti-Greenwashing: Advertisers must be able to provide valid certifications, eco-labels, or verifiable proof of their product’s biodegradable and eco-friendly properties upon request. Biolisty strictly prohibits “greenwashing” and reserves the right to remove any listing that makes false or misleading environmental claims.
  • Prohibited Categories: Listings for vehicles, real estate, and electronic devices are strictly prohibited.
  • Condition of Goods: Products must be manufacturable, marketable, and transportable. Second-hand (used) item listings are not allowed.
  • Real Products Only: Advertisers must be the manufacturer, the seller, or the authorized holder of the product. Imaginary products or untested prototypes cannot be listed and will be removed.
  • One Ad Per Product: Only one listing is allowed per unique product.
  • Variations: Separate listings must be created for products with different colors, sizes, contents, or technical specifications.
  • Accurate Pricing: Unless otherwise stated, prices listed must reflect the actual sales price. Listings with artificially low or high prices aimed at dumping, doping, or manipulating competition are prohibited and will be removed.
  • Listing Quality: Advertisers must select the correct category, upload appropriate photographs, use relevant tags, and ensure all provided details accurately match the product.
  • Prohibited Items: Listings for tobacco, alcohol, drugs, gambling, or similar substances are strictly forbidden. Products or links that even evoke or associate with these items cannot be added.

4. Content & Ethical Guidelines

  • Lawful and Ethical Content: Listings must not contain any elements that violate laws, regulations, universal values, religions, beliefs, or personal preferences. Listings contrary to general morals and ethics will not be published, or will be immediately removed if found.
  • Intellectual Property Guarantee: By uploading images, logos, and descriptions, Advertisers guarantee that they own the intellectual property rights or have the necessary permissions to use these materials. Advertisers agree to fully indemnify Biolisty against any third-party copyright, trademark, or intellectual property infringement claims.
  • Malicious Links & Spam: Listings must not contain malicious external links, viruses, malware, phishing attempts, or any digital content designed to harm Users’ devices or extract personal data.
  • No Unauthorized Listings: Advertisers cannot post listings for products belonging to others without a legitimate right or authorization. Such ads will be removed, and the Advertiser will be held liable for any damages suffered by the actual product owner.
  • No Guarantees: Biolisty does not guarantee any sales, marketing success, or performance based on the listings.

5. Rights & Responsibilities

  • Intellectual Property and Trademark Rights: The name ‘Biolisty’, its logos, branding, website design, software architecture, and all proprietary content provided on the Site are the exclusive property of Biolisty and are protected by applicable copyright, trademark, and intellectual property laws. ‘Biolisty’ is a registered trademark. Users, Advertisers, and any third parties are strictly prohibited from copying, reproducing, distributing, scraping, extracting, or using the Biolisty name, logos, or any site content (including the directory database and other users’ listings) for any commercial or non-commercial purpose without explicit, prior written permission from Biolisty. Any unauthorized use, infringement, or imitation will result in immediate legal action and claims for damages.
  • Advertiser Liability: All responsibility for the product, its sale, delivery, and any relationship established with the User belongs entirely to the Advertiser. Biolisty is not responsible for any negative outcomes.
  • Indemnification: If Biolisty incurs any damages or expenses due to the actions, listings, or rule violations of an Advertiser or User, the responsible party must cover all costs and damages.
  • Legal Compliance: Advertisers agree that they are aware of, and will comply with, the legal regulations in the User’s location when contacted. Biolisty holds no liability for legal breaches by the Advertiser.
  • Content Rights: Biolisty reserves the right to remove, edit, or suggest changes to any listed products. The site may also remove expired listings or post sample/promotional ads at its discretion.
  • Corrective Action: Biolisty is not liable for ad content. In case of any negativity or rule violation, the ad is suspended, and the owner is notified to correct it. If corrected compliantly, it may be republished.
  • Site’s Usage Rights: Biolisty has the right to use all visuals and information uploaded by Advertisers or Users for promotional and publication purposes across any medium. Advertisers cannot claim copyright or compensation for such use.
  • Data & Communication Consent: Users and Advertisers explicitly consent to providing their information willingly. They agree that Biolisty can use this information to promote the site and products, contact them, and share details with third parties to achieve the platform’s goals.
  • Rule Modifications: Biolisty reserves the right to change, update, or remove these rules at any time. Advertisers accept that they post listings knowing Biolisty holds no liability regarding those listings.
  • Jurisdiction & Legal Disputes: Any legal disputes arising from the use of the Biolisty platform, or relating to these terms, shall be governed by the laws of the State of New Mexico, USA. Advertisers and Users agree to submit to the exclusive jurisdiction of the courts located in Albuquerque, New Mexico.
  • Acceptance of Policies and Future Modifications: By accessing the Site, registering an account, or publishing a listing, Users and Advertisers explicitly agree to be fully bound by these Publishing Rules and Guidelines and our Privacy and Cookie Policy. Biolisty reserves the right to modify, update, amend, or remove any part of these rules and policies at its sole discretion, at any time, and without prior notice. It is the responsibility of Users and Advertisers to review these documents periodically. Continued use of the Site following the implementation of any changes constitutes your full acknowledgment, consent, and acceptance of the updated terms.
